ORDER The Connission will not review the April 25, 1988 Memorandum and Order of the Appeal Board, ALAB-891; howevu, the Comission directs the Licensing Board to determine whether the remanded coexial cable issue need be resolved before low-power operations.

In ALAB-891, the Appeal Coard indicated that the Licensing Board should net deternine at this time whether the remanded coaxial cable issue need be resolved before low-power operations. The Appesi Board believed a determination was unnecessary now because pendency o' the public notification issue, which it had remanded in ALAB-583, currently precludes low-pou r operations and because liti3ation of that issue gives no indication of being brief. ALAB-891, slip op. at 26 n.66.

There is a pending rulemaking regarding errergency planning requirements for low-power operations. See 53 Fed. Les 15435(1988).

The coment period has concluded. The rule, as proposed, has the potential to remove the public notification issue as an obstacle to low power, wnich could possibly leave the coaxial cable issue as the sole issue before the Licensing Board for onsite emergency plar.ning and safety issues. Thus, the Commission bclieves that the Licensing Board should promptly initiate the process by which it will make the directed de termination.
