NRC INTEGRATED INSPECTION 50-333/97-02 AND NOTICE OF VIOLATION

Dear Mr. Colomb:

On April 12,1997 the NRC completed an inspection a; your FitzPatrick Power Plant. The

enclosed report presents the results of that inspection.

i

Overall, plant operation activities were conducted well. However, on March 3, a licensed

reactor operator mistakenly withdrew one control rod. The results of the review of that

event are documented in a specialinspection repon iio. 50-333/97003. Additionally, a

'

longstanding problem associated with shutdown cooling initiation was not resolved in an

!

effective manner which led to additional challenges to safe plant operation. The security

,

program was in:pected during this period and was determined to be effective.

l

Based on the results of this inspection, the NRC concluded that the failure to implement

corrective actions by installing a modification for a high point vent to prevent spurious

shutdown cooling isolations was a violation of 10 CFR 50 Appendix B. This violation is

cited in the enclosed Notice of Violation and the circumstances surrounding the violation

are described in detail in the enclosed report. Please note that you are required to respond

,

to this letter and should follow the instructions specified in the enclosed Notice when

preparing your response. The NRC will use your response, in part, to determine whether

further enforcement actions is necessary to ensure compliance with regulatory

'

requirements.

'

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter

and its enclosures will be placed in the NRC Public Document Room.
