Disposition of Utah Conantion H -Inadequate Thermal Design (May 19,1999) i

(" Applicant's Motion").2 This Opposition is supported by the Declaration of Dr.

Marvin R'esnikoff Regardin'g Material Facts in Dispute With Respect to Contention H, Bases 3,4, and 5 (June 14,1999) ("Resnikoff Declaration"). The Applicant, Private Fuel Storage, LLC ("PFS"), st.eks summary disposition with respect to Bases 3,4, and 5 of Contention H, on the ground that the Applicant has provided the information sought in those bases,'and therefore there is no longer any dispute between the parties.

The Applicant is incorrect. The limited information that the Applicant has provided 1
