10 CFR 50.59 l

The subject paper, issued on February 12, 1997, forwarded proposed regulatory guidance on implementation of 10 CFR 50.59 to the Comission, with a recomendation that it be issued for public coment. As noted in the paper, the proposed guidance reaffirms existing practice in many areas, clarifies staff expectations and positions in areas where industry practice or position differs from the staff's expectations, and establishes guidance in areas where i

previous guidance did not exist.

To the extent that clarified and new positions are expressed therein, the document does not represent f!.ia? agency policy; thus, the use of particular positions in enforcement matters inay raise backfit concerns.

If there are questions about the applicability Of any of the guidance contained in the Comission paper to plant-specific in:oection issues, please consult with my staff prior to taking enforcement action using the positions contained in the paper.
