Rogers are not with us this morning.
5 I understand we have one item before us for 6
affirmation.
Before asking the Secretary to walk us through 7
the item, do any of my fellow Commissioners have any comments?
8 If not, Mr. Hoyle, would you proceed, pleas ~e.
9 MR. HOYLE:
Thank you, Mr. Chairman.
10 The one item is SECY 88-26, the title of which is 11 Response to Certified Question Propounded by the Appeal Board 12 to the Commission in the Matter of General Public Utilities 13 Nuclear.
14 In this paper the Commission is being asked to 15 approve an order responding to a question certified to it by 16 the Appeal Board as to whether the Commission wishes to expand 17 the subject matter jurisdiction of this proceeding 18 retroactively to include information regarding Mr. Charles 19 Husted's job performance following the cheating incidents.
20 All Commissioners have approved the order with 21 modifications suggested by Commissioners Carr and Bernthal 22 which responds in the affirmative to the certified question.
23 I would ask the three Commissioners present to affirm
