PRODUCED IN NON-POWER REACTORS Region IV, in.a letter dated June 8, 1987, requested guidance regarding the regulatory responsibilities for byproduct material that has been removed from 1
a non-power reactor (Enclosure 2).
In a memorandum from D.-Crutchfield to all Regions (Enclosure 3) we requested comments from the Regions with regard to this issue. Enclosures 4-8 contain.the Regions' response. We drafted a proposed policy and sent it to the Regions for. comment (Enclosure 9).
Enclosures 10-14 are the Regions' coments with regard to the proposed policy.
As a result of comments on the proposed policy guidance, we recomend the-l policy outlined in Enclosure 15 be issued as an Information Notice to non-power reactor licensees, original signed by Lester S. (technical specifications) or a boundary'definod by the SAF(as dreed to by the Region and the licensee) will be unc'er he juqisdiction of theN10 g
CFR Part 50 license. Outside this boundary, t' e byproduct material must be transferred to, and will be under the jurh iction of a materials license or an Agreement State license, unless the material.has b en transferred to a carrier.
In that case, the transfer can teimade at the boundary as defined above, at the point of transfer to e carrier, er at '
the destination of the material. Under these conditions, the Part 50 j
license is the controlling license until such time as the tran*,fer takes place.
An example of byproluct material under this section is the irradiation of a target to produce an isotope.

Irradiated Byproduct Material Retrradiated by a A -Power Reactor The materials license or Agreement St, ate license will be in force, even within the boundaries defined in Section 1, until such time as the r.aterial is reirradiated. Upon reirraJiation, the regulatory bot.ndaries defined in Section 1 apply.
