SUBJECT: NRC REGION '1 INTEGRATED INSPECTION REPORT NOS. 50-317/99-03

AND 50-318/99-03 AND EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Cruse:

This report transmits the findings of the safety inspection conducted by NRC Inspectors at the

Calvert Cliffs Nuclear Power Plant from March 21,1999 to May 8,1999. At the conclusion of the

inspection, these findings were discussed with Mr. Katz and others of your staff.

Overall, the NRC has concluded that your facility was operated in a safe manner. Your conduct

of activities during the period was generally characterized by safety-conscious operations,

sound engineering and maintenance, and careful radiological controls. Outage operations on

Unit 2 were conducted in a careful, deliberate manner with proper attention to plant and worker

safety.

The inspectors reviewed the adequacy and implementation of radiological controls during the

Unit 2 outage, including implementation of various radiation protection program improvement

initiatives. The reviews indicated you had implemented improved and effective radiological  ;

controls for the outage.

Based on the results of this inspection, a violation was identified which could be considered for

escalated enforcement and be subject to a civil penalty. The violation involved an emergency

diesel generator (EDG) being inoperable for a period of time in excess of the outage time

allowed in technical specifications. The inoperability of the IB EDG was the result of foreign

material introduced during a modification to the govemor control system. The NRC staff found  :

that your foreign materials exclusion (FME) measures were not unreasonable in light of the

. Information availableat t: 1 time. Also, your corrective actions for this specific event were

commensurate with the e My significance of the emergency diesel generator. Accordingly, in

. consultation with the Res.onal Administrator, NRC Region 1, and the Director, NRC Office of

Enforcement, I have been authorized to not issue a Notice of Violation and not propose a civil

penalty for this Severity Level lil violation in accordance with the provisions provided in Section

Vll.B.6 of the Enforcement Policy.

The NRC has also determined that two Severity Level IV violations of NRC requirements j

occurred. These violations are being treated as non-cited violations (NCVs), consistent with  ;

Appendix C of the Enforcement Policy. These violations are described in the subject inspection l
