ACKNOWLEDGEMENT OF RESPONSE TO NOTICE OF VIOLATION

Dear Mr. McCormic:

This is to acknowledge receipt of your April 20,1999, response to the Notice of Violation the NRC issued to you on March 25,1999.

We have reviewed your response and believe you have adequately addressed the NRC's concerns at this time. The NRC plans no further action and considers this enforcement action closed.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, enforcement actions are placed in the NRC Public Document Room (PDR). Therefore, the NRC is placing copies of its March 25,1999, letter and Notice of Violation to you and your April 20,1999, response into the PDR, with your home address and certain privacy information removed from these documents.

Your April 20,1997, letter specifically requested that your name and address and your entire response be withheld from public disclosure on the basis it contained confidential information.

While your home address will be removed from copies of correspondence placed into the PDR, there is no basis for removing your name from such correspondence, particularly since you are an NRC license holder. In addition, while we have removed certain privacy information from l your response, as you will see in the Enclosure, therc !s no basis for withholding your entire response from the POR as it relates to an official agency enforcement action.
