NOTICE OF VidLATION
Dear Ms. Larsen:
This refers to your letter dated October 30,1998, notifying our office of your loss of a polonium-210 static eliminator. The static eliminator (NRD, Inc. Model P-2051) contains approximately 10 millicuries of polonium-210. On or about September 29,1998, the static eliminator was discovered missing. Search efforts to recover the missing static eliminator have proven unsuccessful. Your investigation to date has concluded that the device was most likely disposed of as ordinary trash.
After reviewing this incident, the NRC has determined that a violation of NRC requirements occurred. This violation is cited in the enclosed Notice of Violation. A written response is not required because your report of the loss dated October 30,1998, identifies action taken by you to prevent future losses.
Although the amount of polonium-210 discarded was small, the violation demonstrates the importance of maintaining adequate control of all radioactive material to ensure that improper handling or disposal does not occur. We caution you that any similar violations in the future may result in additional enforcement action, including the imposition of monetary penalties and/or orders suspending, revoking or modifying your license.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its enclosure will be placed in the NRC Public Document Room, along with a copy of your notification of loss.
