This office letter provides procedures to ensure that NRR responsibilities i

related to Section 208 of the Energy Reorganization Act of 1974 are fulfilled in an efficient, effective, and timely manner.

NRR responsibilities relative i

to the Act are defined in NRC Manual Chapter 0212, "Abnormal Occurrance Re-

l DEFINITIONS Abnormal Occurrence.

An unscheduled incide1t or event that occurs at or is associated with any facility licensed or otherwise regulated by the NRC that the Commission determines is significant from the standpoint of public health or safety.

The criteria for such deterwinations are given in Part I of the Appendix to NRC Manual Chapter 0212.

Potential Abnormal Occurrence.

An event that appears to meet the criteria for reporting an event as an Abnormal Occurrence (AO).

Other Related Items.

The following categories of non-A0s and information re-lated to previously reported A0s: Other Events of Interest, Other Events Con-sidered for Abnormal Occurrence Reporting, and Updating Material.

Events defined in Part III of the Appendix to NRC Manual Chapter 0212.

(2) Other Events Considered for Abnormal Occurrence Reporting.

Events considered as Potential A0s, but that after further review are judged not to meet the criteria for A0 reporting (see Part IV of the Appendix to NRC Manual Chapter 0212).

(3) Updating Material.

Subsequent information that characterizes the root I

cause of an event or the action taken to prevent recurrence, or that updates the understanding of an event or its ultimate disposition (see Part V of the Appendix to NRC Manual Chapter 0212).

POLICY The Office for Analysis and Evaluation of Operational Data (AE0D) has overall NRC staff responsibility for preparing A0 reports for disseminating to the public and for informing the Congress.

NRR's role in supporting this AE00 function is presented in NRC Manual Chapter 0212, and includes the following j

activities:

(1) Propose to AE0D an event for consideration as a Potential A0 within 15 days after the event occurs.

(2) Propose to AE0D events for consideration as Other Events of Interest within 20 days after an event occurs.

(3) Evaluate, as requested by AE00, Potential A0s for safety or environmental implications.

l (4) Provide, as requested by AE00, comments /concurren e On proposed A0 reports l

(5) Provide, as requested by AE00, Updating Material on previously reported A0s.

In addition, discuss the genesis of each action and assess each related incident to determine whether it should be reported as an A0.

However, signature authority is delegated to the Director, Division of Operational Events Assessment for matters that do not involve new policy issues or controversial issues.

Reviews and concurs in all correspondence to AE00 pertaining to A0s and Other Related Items, signed by the Director, NRR.

Director, Division of Operational Events Assessment (00EA), NRR.

(1) Coordinates NRR activities related to reporting A0s and Other Related Items and signs correspondence to AE00 pertaining to A0s and Other Related Items where such correspondence does not involve new policy issues or controversial issues.

(2) Acts as NRR representative on matters pertaining to A0s and Other Related Items.

Chief, Events Assessment Branch, NRR.

(1) Serves as the contact point within NRR for coordinating the review and evaluation of A0 proposals.

(2) Evaluates proposals on A0 events received from NRR Divisions.

(3) Recommends to the Director, NRR (or designee), that a proposal transmitted to AEOD be given/ denied A0 status.

(4) Prepares for the signature of the Director, DOEA, or higher level of NRR management where appropriate, correspondence to AE0D transmitting proposals on A0 events and information on Other Related Items.

(5) Represents NRR as an alternate on matters pertaining to A0s and Other Related Items.

BASIC REQUIREMENTS Reporting Requirements Section 208 of the Energy Reorganization Act of 1974 requires the Commission to (1) inform the public of each A0 within 15 days of the Commission deter-mination that an event is significant to public health or safety and (2) submit e

to Congress a quarterly report containing the Commission determinations for the A0s that have occurred during the reporting period.

By way of clarification, A0 information will be disseminated to the public through Federal Register notices; only quarterly compilations of events will be disseminated.

The magnitude of the effort to process event-related in-formation and competing priorities has led to the cessation of the reporting of individual A0s.

The criteria that establish the threshold for reporting an event as an A0 are documented in a Federal Register notice published on February 24, 1977 (copy enclosed).

These criteria were developed to comply with the legislative intent of Section 208 of the Energy Reorganization Act of 1974 (i.e., to keep the Congress and the public informed about unscheduled incidents or events that the Commission considers significant from the standpoint of public health or safety).

Under the direction of DOEA, operational events reported in accord-ance with the immediate notification requirements of 10 CFR 50.72 and other operational experience are evaluated on a daily basis to identify the more significant events for subsequent staff action and consideration as Potential A0s.

Because of the need to inform the public about A0s and to provide a compilaticn of A0s to Congress on a quarterly basis, certain A0s may, at first, not be reported completely.

Thus, to fully comply with the reporting requirements of Section 208 of the Energy Reorganization Act of 1974, updating material on previously reported A0s shall be provided in subsequent quarterly A0 reports to Congress anc' disseminated to the public through Federal Register notices.

The reporting recuirements of the quarterly A0 reports have been expanded to meet Commission directives.

The draft quarterly A0 report submitted to the Commission includes Other Ewents Considered for Abnormal Occurrence Reporting, and the final quarterly report to Congress includes Other Events of Interest.

NRR Procedure for Proposing an Event as a Potential Abnormal Occurrence Any Division or individual within NRR may propose an event as a Potential AO.

This should be done as soon as possible after an event has occurred.

Candidate events are most likely to be selected from a compilation of significant events or from events on which management was briefed during the weekly operating events briefing.

Proposals for potential A0s should be transmitted by the Division Director to the Director, 00EA, for review and consideration.

00EA will be responsible for evaluating the proposals and for determining whether a proposal should be transmitted to nE0D.

I NRR Procedures for Responding to Requests for Assistance From Outside NRR From time to time, NRR will be asked to perform safety and environmental evaluations of events that have occurred at operating reactor facilities or to gather additional informacion regarding such events.

For the most part, such requests will come directly to the Director, NRR, and will be referred to DOEA for coordination.

Should employees within NRR be contacted directly by AE00 (or by any other Office) for assistance related to these matters, l

they should refer the matter to DOEA to ensure proper coordination of respon-sibility for preparing an NRR response.

EFFECTIVE DATE This office letter is effective immediately.
