REPLY TO NOTICE OF VIOLATION AND PROPOSED IMPOSITION 07 CIVIL PENALTY AND PAYMENT OF CIVIL PENALTY (Reference NRC Letter EA-87-164 dated November 1, 1988)

Dear Sir:

Attached is Boston Edison Company's reply to the Notice of Violation and proposed imposition of civil penalty contained in the subject letter. Boston E.11 son accepts full responsibility for tne actions of its ertployr.et and its contractors. A check for $50,000 is enclosed as full payment of the civil penalty.

In accordance with the guidance in NRC Letter FA-07-164 dated November 1, N 1988, previous correspondence and meetirgs are referenced to answer Violations I.A.1, I.A.2, II.I II.2. A direct response to Violation II.B regarding a g material false statement and the findings of OI Case 1-87-009 "Synopsis" is by/d provided in Attachment 1.

Boston Edison has not and will not tolerate lying by employces or

@]o contractors. Investigation into this matter has determined that the subject material false statement by a contractor to an NRC inspector is an isolated ED, incident. The individual who lied to the NRC inspector was imediately denied 88 site access by Boston Edison and subsequently fired by the security contractor.

, m 8 Boston Edison believes tha*. the recent upgrades in the security program have been effective and demonstrate corporate comitment to improvement. These 8@0.0 upgrades include an experienced security manager, increases in staffing and experience of Boston Edison security supervisors, and addition of new equipment. NRC letter EA-87-164 states that Boston Edison "has demonstrated a comitment to implement an effective security program." In addition, security improvements are recognized in the NRC Integrated Assessment Team Inspection (50-293/88-21 dated 9/7/88) and the most recent Systematic Assessment of , )#

In conclusion, the commitment to improve the security program remains strong and has been demonstrated by completed and planned improvements. The security program is well controlled and the corrective actions taken in response to the violations provide reasonable assurance against recurrence. Boston Edison considers this matter closed.
