Y OMB SUPPORTING STATEMENT FOR NRC FORM 450, GENERAL ASSIGNMENT Description of the Information Collection As a part of the cuntract closeout process for cost reimbursement and time and materials type contracts, the contractor is required to assign to the Government all rights, title and interest to refunds, rebates, credits or other amounts (including interest, if any) arising out of contract performance ar.d certify that a corporate official is empowered to make the assignment. The contractor utilizes NRC Fom 450 to make such assignments.
A. JUSTIFICATION
- 1. Need for the Collection of Information. Contract clauses 52.216-7, Allowable Cost and Payment (APR 1984) and 52.232-7, Payments under Time and Materials and Labor Hour Contracts (APR 1984) prescribed by the Federal Acquisition Regulation (FAR) for inclusion in cost reimbursement and time and materials contracts require execution and deliverv of the assignment, in form and substance satisfactory to the Contracting Officer as a condition precedent to final payment.
- 2. Agency Use of Information. General Assignment forms are reviewed upon receipt to assure proper execution and certification. They then become an integral part of the official contract file serving as the legal basis for subsequent actions required on the part of the Contractor for collection of all refunds, rebates, credits or other amounts properly allocable to costs for which the Contractor has been reimbursed by the Government under the contract, and payment of proceeds collected to the Goverament.
- 3. Reduction of Burden Through Information Technoloay. The burden represented by the execution and certification of the General Assignment is minimal thus the opportunity for reduction of burden through information technology does not present itself.
Notwithstanding, the need to maintain legal sufficiency of the assignment could pose a legal obstacle in consideration of use of infomation technology for reduction of burden. However, if any such concerns can be satisfied, NRC has no objection to use of information technology to reduce the burden.

- 4. Effort to Identify Duplication. The Federal Information Locator System was searched and no duplication was found.
- 5. Effort to Use Similar Information. The infomation is contract
! specific thus similar information does not exist which could l
satisfy the specific contractual requirement. In an effort to l
reduce the overall burden to the contractor, NRC in its contract l closeout process, forwards the General Assignment for execution at l the same time as the contractor's "release" also required by the cited FAR clauses.

- 6. ~ Effort to Reduce Small Business Burden. The information collection is prescribed by the Federal Acquisition Regulation. The collection represents the minimum required for proper execution of the General Assignment and cannot be reduced.
- 7. Consecuences of less Frequent Collection. . Not applicable. The information collection is required only once, at the time of contract closeout.
- 8. _ Circumstances Which Justify Variation From OMB Guidelines. The.
collection is within all OMB prescribed guidelines.
- 9. Consultations Outside the NRC. None.
- 10. Confidentiality of Information. Execution and certification of the General Assignment does not require use of confidential information. Any subsequent submission of proprietary or business confidential infonnation would be protected against improper disclosure as required by the Federal Acquisition Regulation, the Freedom of Information Act and NRC Manual Chapter 2100, "NRC Security Program."
- 11. Justification for Sensitive Questions. No sensitive information normally considered private or personal infonration is required or requested.
- 12. Estimated Arnualized Cost to the Federal Government. The cost to the Agency attributable to this form is 53,000. The cos+ to the Government was derived from experience as to the approximate number o' hours Contract Specialists expend in assurino that the form is properly executed and that the contractors comply with the form.
The hours were thn rr.ultiplied by the standard of $60/ hour to arrive at the approximate cost to the Government (50 hrs x $60 hr =
$3,000).
- 13. Estimate of Burden. The annual contractor burden for this form is estimated to be 200 hours0.00231 days <br />0.0556 hours <br />3.306878e-4 weeks <br />7.61e-5 months <br />. The burden estimate was derived from experience as to the approximate number of contractors affected by the General Assignment form and the approximate number of hours each contractor would have to expend to comply with the requirements of the form (100 respondents x 2 hrs per response).
14 Reasons for Chance in Burden. There is no change in the estimated burden.
- 15. Publication for Statistical Use. Results will not be tabulated or published.
B. COLLECTIONS OF INFORMATION EMPLOYING STATISTICAL METHODS This collection of information does not employ statistical methods.
