AMENDMENT TO 10 CFR PARTS 11 AND 25: REVISED FEE SCHEDULE Enct for your signature is a Federal Register Notice amending 10 CFR Part 11,
'Criu 3nd Procedures for Determining Eligibility for Access to or Control Over b .' Nuclear Material" and 10 CFR Part 25, "Access Authorization for Licerne N sonnel."
The Office of Personnel Management conducts access authorization background investigations for the NRC and sets the rate it charges the NRC for these investigations. On May 1, 1987, OPM increased the rate that it charges the NRC :
by approximately 15%. Since the fees that NRC charges its licensees for material access authorizations and personnel security clearances are dependent on the rates charged by OPH for conducting background investigations, the fee schedules in NRC regulations are being amended to reflect OPM's rate increase. The amendments also make a minor office name change in Part 11, and amend Appendix A of Part 25 to be consistent with the fee schedules in Part 11.
Because these are amendments dealing with agency practice and procedure, the notice and coment provisions of the Administrative Procedure Act do not apply pursuant to 5 U.S.C. 553(b)(A). The amendments are effective upon publication .
in the Federal Register. Good cause exists to dispense with the usual 30-day delay in effective date because the amendments are of a minor and administrative nature dealing with an adjustment in access authorization fees.
Congressional comittees will not be informed of this action. A public announce-ment will not be prepared.
Notes regarding the issuance of this rule will be included in the next Weekly Report to the Comission.
The Office of Administration and Resources Management (ARM /DISS) will notify affected licensees and other interested persons of this rulemaking initiative.
