Subject:
Solicitation No. RS-AED-87-129 Entitled "Emergency Response Data System Implementation" This letter confirms the telephone conversation on September 28, 1987 between Mrs. Deborah Demarco, of my staff, and Mr. Dale Lundblade, Manager of Contracts, EI International, Inc., whereby you were given notification that your organization had been selected for a contract award under subject solicitation.
As mutually agreed, no work shall commence under this contract pending resolution of the protest filed by Phoenix Associates, Inc. to the General Services Administration Board of Contract Appeals (GSBCA).
It is agreed that this action is a no cost suspension and should the GSBCA direct action inconsistent with this award, EI International, Inc. agrees that it is not entitled to termination costs.
At such time the government directs the contractor to proceed with performance of work under the contract after resolution of the protest, the contract schedule shall be adjusted on a day for day basis equivalent to the period of delay in performance resulting from the suspension.
