Dear Ms. Bauman:

This letter responds to your November 6, 1987 appeal of a 1 l

partial denial of documents in the Nuclear Regulatory Commission's October 29, 1987 letter in response to FOIA-87-596.

In response to your appeal, I have re-reviewed the documents withheld in Appendix C and I have determined that the documents are not subject to mandatory disclosure under the Freedom of Information Act (*FOIA"). These four documents are draft letters and are exempt from disclosure under Exemptions 5 and 6 of the FOIA, 5 U.S.C. 552 (b)(5) and (6),

and 10 C.F.R. 9.5(a)(5) and (6) of the Commission's regulations.

Initially, these documents are draft letters submitted by the Executive Director for Operations ("EDO") to the l

Commissioners for their comment and review prior to theit issuance by the EDO to the various individuals involved in this action. Accordiagly, these documents are predecisional and a part of the Commission's deliberative process.

The purpose of the deliberative process privilege is to "prevent injury to the qublity of agency decisions." NLRB v.

of these predecisional documents would be likely to "stifle honest and frank communication within the agency." Coastal States Gas Corp. v. Department of Energy, 617 F.2d 854, 866 (D.C. Cir. 1980).

Furthermore, these letters contain comments on the jcb performance of certain, specific individuals. Therefore, release of this information 'would constitute a clearly unwarranted invasion of personal privacy." 5 U.S.C.

Exemption 6 protects this information from mandatory disclosure, even though it may not be contained in that individual's personnel file. The protection of an individual's privacy interests ' surely was not intended to turn upon the label of the file which contains the damaging information.' Department of State v. Washington Post Co.,

456 U.S. 595, 651 (1982). I have concluded that the privacy interests of the individuals involved in this situation outweighs the public's right to disclosure. Department of the Air Force v. Rose, 425 U.S. 352 (1976). Courts have consistently upheld similar balancing of privacy interests.

Dear Mr. Stello,

This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C. 552), of the actual denial of the commission to release dcouments requested on September 1, 1987 by the Government Accountability Project.

By letter dated Oct. 29, 1987 Donnie H. Grimsley, Director of the Division of Rules and Records, informed us that Appendix,C-1 being with eld from disclosure in their entirety pursuant to FOIA Exemption because the withheld information consists of interagency intraagency records that are not available through discovery litigation.

Disclosure of predecisional inf'ormaiton would tend to inhibit the open and frank exchange of ideas essential to the deliberative process and the withheld information is exempted frompublic disclosure because its disclosure would result in a clearly unwarrented invasion of personal privacy. EXEMPTION 6 We believe we are entitled to the relase of the documents being withheld.

We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to pursue this matter further in the courts.- .
