SUBJECT:

WAIVER OF CRGR REVIEW FOR COMBUSTION ENGINEERING OWNERS GROUP TOPICAL REPORT CE NPSD-951, REVISION 1, " REACTOR TRIP CIRCUIT BREAKERS SURVEILLANCE FREQUENCY EXTENSION" Attached (Attachment 1 and 2) respectively, is the transmittal letter and safety evaluation repcd

' (SER) prepared by the Division of Engineering. In this SER the staff accepted extension of i

Reactor Trip Breakers (RTCB) surveillance test interval (STI) from a monthly to a quarterly i

schedule and rejected extension of allowed outage time (AOT) to close an inoperable RTCB to perform surveillance test on other RTCBs from one hour to two hours, as proposed in Combustion Engineering Owners Group (CE'OG) Topical Report CE NPSD-951, Revision 1.

The topical report provide 1 justification for the proposed extension of RTCB STI and AOT. The staff determined that the opical report data and analyses supported the proposed STI extension but did not st,pport an AOT extension from the currently allowed one hour to two hours. CEOG agreed with the staff that CEOG has not provided sufficient information to support this particular change request.

Also attached (Attachment 3), in accordance with the CRGR charter, is the NRR office director's determination that the generic technical specification relaxation to extend RTCB STI from monthly to quarterly, as proposed in the subject topical report and approved by the staff, will continue to adequately maintain public health and safety. We believe that a formal CRGR review of the attached SER is not necessary because approval of the RTCB STI extension does not create a new staff position or change existing staff positions. The staff proposes that the Committee to Review Generic Requirements (CRGR) review be waived in accordance with the CRGR Charter, Revision 6. If you agree that a CRGR review is not necessary, please inform us as soon as possible. Otherwise, the staff will prepare an appropriate CRGR package.

the AOT extension, (2) incorporate this letter and the enclosed SER between the legal notice page and executive summary page, and (3) include an -A (des;gnated accepted) following the report identification symbol (CE NPSD-951). Should our acceptance criteria or regulations change so that our conclusions as to the acceptability of this report are no longer valid, the CEOG and/or the licensees referencing this topical report will be expected to revise and resubmit their respective documentation, or submit justification for the continued applicability of the topical report without revision.
