Dear Mr. Graham:

This is in response to your request of November 12, 1988, for the Comission to extend the public coment period on the proposed fitness-for-duty rule.

As further discussed below, the Comission has provided ample opportunity for public awareness of and participation in this rulemaking process. Accordingly, your request must be denied.

Comments on the proposed rule should be submitted by November 21, 1988.

Nevertheless, coments received af ter that date will also be considered if it is practical to do so. However, we cannot assure full consideration except as to comments received by November 21, 1988.

The Comission indicated it was considering this rulemaking and discussed the general contents of the proposed rule during a public meeting on December 1, 1987. The contents of the proposed rule (SECY 88-129) were dis.

cussed in detail during a public meeting on June 21, 1988.

The Comission held still another public meeting in Rockville, Maryland on October 17, 1988, to further public understanding of the issues and to facilitate the public coment process.

We appreciate your interest in this rulemaking and will give your written coments careful consideration when they are received. We will inform you if there is any change in comment period associated with this rulemaking.

Dear Sirs:

I respectfully request an extension of 90 additional days in order to submit public comment with regard to the notice published in the Federal Register on September 22, 1988 Vol.

53, Number 184, dealing with the fitness for duty issue for nuclear power plant workers.

I feel that the time allotted by the commission is not sufilcient for gathering public comment in which to adequately address the issue.
