Dear Mr. Dominguez:

This is in response to your request of November 12, 1988, for the Commission to extend the public coment period on the proposed fitness.for-duty rule.

As further discussed below, the Commission has provided ample opportunity for public awareness of and participation in this rulemaking process. Accordingly, your request must be denied.

Coments on the proposed rule should be submitted by November 21, 1988.

Nevertheless, coments received after that date will also be considered if it is practical to do so.

However, we cannot assure full consideration except as to coments received by November 21, 1988.

The Comission indicated it was considering this rulemaking and discussed the general contents of the proposed rule during a public meeting on December 1, 1987.

The contents of the proposed rule (SECY 88-129) were dis-cussed in detail during a public meeting on June 21, 1988.

The Comission held still another public meeting in Rockville, Maryland on October 17, 1988, to further public understanding of the issues and to facilitate the public coment process.

We appreciate your interest in this rulemaking and will give your written coments careful consideration when they are received. We will inform you if there is any change in comment period associated with this rulemaking.
