Commissioner Roberts requested OGC's position as to whether guidance to Federal agencies signed by the President is sufficient justification gar na to preempt the backfit requirements of 10 CFR 50. 109, as the staff argued in SECY-88-315.

On the same issue, Counsel to review whether there is any benefitCommissioner Curtiss req limited nature of the waiver, in given the CFR Sec. 50.12 to the Commission' granting an ex,emption under 10 s backfitting regulations versus the approach suggested by the staff, which is to waive the backfit rule but not apply the 50.12 exemption.
(Subsequent to the briefing, the General Counsel, by memorandum dated November 22, 1988, responded to Commissioner Curtiss' request.)
Commissioner carr requested the staff to inform the Commission of NRC procedures for the con: rolling and accounting of radiation exposure to NRC employees and NRC contractors.
