MONTHLY STATUS REPORT ON PLANT-SPECIFIC BACKFITTING ACTIVITIES - OCTOBER 1987 Enclosed is NRR's monthly status report on plant-specific backfitting activities current through October 31, 1987. Enclosure 1 provides a summary of changes in the status of backfit issues that have occurred since the last report. provides the status of active issues listed by the Division responsible for resolving the backfit issue. Feedback provided in accordonce with Office Letter No. 52 will be used to update this report on a monthly basis.

The report format for Enclosure 2 has been modified to list the next action due date, and what organistlon is responsible for the action. Due dates are based on the requirement < c" Manuti Chapter 0514 where appropriate, or estimates of when the neu action will occur.

SUMMARY

H.B. ROBINSON: The licensee claimed a backfit on the testing of relief and safety valves for TMI item II.D.1 The staff issued its determination on April 9, 1987 finding that the issue was not a backfit. The licensee submitted a proposed procedure change in July. The staff reviewed this information, and notified the licensee by letter dated 9/30/87 that its response satisfactorily addressed our concern. The licensee comitted to accomplish the procedure change within thirty days of receipt of our letter.

This issue is therefore closed.

CATAWBA 1 and 2, and MCGUIRE 1 and 2, and OCONEE 1, 2 and 3: Duke Power Company submitted a backfit claim in a letter to the staff dated September 1, 1987. The licensee asserted that the NRC staff's interpretations of two 10 CFR 50, Appendix J, items constitute backfits as defined by 10 CFR 50.109.

The two items are:

(1) the staff's reluctance to allow short-duration tests using the Mass-Plot (or Mass-Point) analysis method, and (2) the staff's requirement that as-found (type B or C) leakage be included in Type A test results. These items relate to the performance of the containment integrated leak rate testing (CILRT). The staff notified the licensee by letter dated Ocotober 29, 1987 that it had determined that the staff position regarding

testing duration and agreeing perties is not a backfit as defined by 10 CFR 50.109. The requirements of ANSI N45.4-1972 incorporated by reference into the regulation allow for shorter tests with NRC approval, but such approval must be formal and explicit, in so far as it represents a deviation from the basic explicit regulatory requirement. Tacit approval in inspection reports does not suffice. Also, the staff informed the licensee that Information Notice 85-71 is not subject to the provisions of the backfit rule because it was issued before the effective date of the rule. This issue is closed by issuance of the October letter dated October 29, 1987.
