Dear Senator Boschwitz:

We are pleased to provide you with information that responds to Mr. Roy L.

Spaulding's letter of April 28, 1988.

In his letter. Mr. Spaulding expressed concerns about:

(1) th roblems associated with authorizing full-power operations for the oreham luclear Power Station and (2) the protracted i

schedule for resolu o the problems associated with the shutdown of the i

Peach Bottom Atomic Power Station, Units 2 and 3.

The Comission on December 3,1987 promulgated its new rule governing the treatment of emergency planning issues in cases of State or local non-participation in emergency planning.

The new rule states that the NRC will evaluate the adequacy of the applicant's emergency plan, taking into account the probable response of State and local authorities.

FEMA, as the cognizant Federal agency for offsite emergency preparedness, is evaluating LILCO's offsite emergency plan to determine if there is reasonable assurance that the health and safety of the public can be protected.

In conjunction with its evaluation, FEMA has scheduled an exercise of that offsite plan for June 7-9, 1988. Any exercise or plan-related issues that are admitted for hearings will be considered by the NRC's Atomic Safety and Licensing Board.

A favorable finding on these matters along with those currently being litigated before the Board and a subsequent favorable Comission decision are required before the full-power license can be issued.

These activities are currently scheduled to be completed by Spring 1989, There have been numerous reports dealing with an agreement in principle by L7LCO j

to sell the Shoreham Station for decommissioning purposes. We have asked LILCO to promptly inform us of whether this causes any change in its plans to seek dn operating license for Shoreham.

With respect to Peach Bottom. Mr. Spaulding correctly notes the Peach Bottom Atomic Power Station (PBAPS) was ordered to be shut down on March 31, 1987 because of operator inattentiveness to duty and other issues that caused the NRC to question management effectiveness in operating the facility. The shutdown order required the licensee to submit a detailed corrective action plan for approval by the NRC before being authorized to restart the PBAPS.

Even though the licensee has made much progress since the shutdown, the licensee has only recently, in April 1988, submitted a revised corrective action plan that has been adopted by the licensee's current management. With respect to this plan, the NRC staff is proceeding with its detailed review of the licensee's proposed basis for returning the PBAPS to operation. The licensee's schedule for completing the activities required in its plan results in a projection of readiness for operation of Unit 2 in November 1988, and for 880620009) 880610 ~

l i Unit 3 in early 1989. The staff is proceeding with its reviews with the objective of ensuring that the underlying problems related to the shutdown are corrected; but the staff will also keep in mind the need to avoid any unnecessary delays in its review schedule.

In sumary, the NRC is not withholding approval for authorizing full-power operations at the Shoreham or Peach Bottom facilities.

For Shoreham, the utility must complete a satisfactory demonstration of its emergency plans and any outstanding hearing issues must be resolved.

For Peach Bottom, the utility m'Ist affirm it has completed its restart plan.

We trust the above information is responsive to the concerns identified by Mr. Spaulding.
