PROCEDURAL AGREEMENT ESTABLISHING THE EPA.NRC INTERFACE COUNCIL Enclosed for your signature please find the "Procedural Agreement between the U.S. Environmental Protection Agency end the U.S. Nuclear Regulatory Commission Establishing an Interface Council."- The purpose of_the Procedural Agreement is to establish procedures for continued informal consultation and coordination between NRC and the U.S. Environmental Protection Agency (EPA). As you are aware, NRC and EPA staff have met periodically since 1936 to discuss and coordinate activities of mutual interest. The Procedural Agreement is necessary to ensure continued coordination and centralized consideration of interrelated NRC/ EPA issues by EPA and NRC staffs.
We have developed the enclosed Procedural Agreement in cooperation with EPA through the EPA-NRC Interface Council.
The other participating NRC offices (i.e., Nuclear Reactor Regulation, Nuclear Regulatory Research, Analysis and Evaluation of Operational Data, and Government and Public Affairs) have als reviewed and approved the Agreement.
In addition, the Office of General Counsel has no legal objection.
EPA is now completing its review and approval of the Procedural Agreement. After the Procedural Agreement is signed by both NRC and EPA, we intend to notice it in the Federal Register.

FROCEDURAL AGREEMENT BETWEEN THE U.S. ENVIRONMENTAL PROTECTION AGENCY AND THE U.S. NUCLEAR REGULATORY COMMISSION ESTABLISHING AN INTERFACI COUNCIL Purpose This Procedural Agreement establishes procedures for informal consultation and coordination between the U.S. Environmental Protection Agency (EPA) and the U.S. Nuclear Regulatory Coninission (NRC). The purpose of these procedures is to assure that an information flow is maintained between the two agencies which facilitates discharge of each agency's responsibilities.
- Further, the EPA /NRC Interface louncil will coordinate activities of mutual interest in each agency with corresponding offices in the other agency and assure that interrelated NRC/ EPA issues receive centralized consideration by EPA and NRC staffs. The "Council" is not intended to supplant any existing program responsibilities of individual offices within EPA or NRC. The Council should promota, however, integrated agency responses to issues of mutual interest.
Background
The NRC and EPA have identified the need for maintaining an eff9(.tive and coordinated interface on a variety of issues of mutual interest and responsibility.
NRC and EPA jointly initiated staff meetings in 1986 as an informal arrangement called the EPA /NRC Interface Council.
The Council has facilitated effecthe consultation and coordination between the agencies.
EPA and NRC agree that a procedural agreement is needed to assure continued effective coordination between the agencies on issues of mutual interest.
The Council will periodically discuss the status of issues of mutual interest including regulatory programs under the Atomic Energy Act, the Low-level Radioactive Waste Policy Amendments Act, the Nuclear Waste Policy Act, the P,esource Conservation and Recovery Act, the Clean Air Act, the Toxic Substances Control Act, and the Comprehensive Environmental Response, Compensation, and liability Act, as amended by the Superfund Amendments and Reauthorization Act of 1986.
Objective _s 1.
To identify offices and staff persons in both agencies having NRC/ EPA interface responsibilities. To encourage and facilitate coordination and cooperation among such persons. To assure proper and adequate EPA and NRC staff representation at meetings between the two agencies.

To identify issues of mutual agency interest that need resolution or that pose particular problems.
To assure mutual staff understandings of relevant EPA and NRC positions and policies on such issues.

To facilitate timely sharing of information between agencies and among Offices and staff having NRC/ EPA interface responsibilities.
s 2-Procedures 1.
NRC office participation in the Council will be coordinated by the Office of Nuclear Material Safety and Safeguards.
EPA office participation will be coordinated by the Office of Solid Waste and Emergency Response.
NRC offices include Nuclear Material Safety and Safeguards, Nuclear Reactor Regulation, Nuclear Regulatory Research, Government and Public Affairs, Analysis and Evaluation of Operational Data, and General Counsel.
EPA offices include Solid Waste and Emergency Response, Air and Radiation, Water, Pesticides and Toxic Substances, External Affairs, Research and Development, and General Counsel.
Each office will designate a focal point or lead staff person for coordinating with the other agency through the Council. Designated contacts will normally serve as members of the Council.

Each agency will prepare and maintain a list of current contacts with the other agency, which will be provided to the other agency through the Council. Offices will also share information through the Council concernir.g plans for meetings or discussions with the other agency and prepare short summary reports of such meetings for distribution to Council members. These reports should highlight items which may impact other Offices.

Copies of percinent correspondence to and from the other agency will be provided to the Council by responsible EPA and NRC Offices.

Offices within each agency will keep each other informed through the Council concerning new issues, ongoing projects, problems, agreetents, and other items, which may be of interest to the Offices or affect their interactions with the other agency.

The Council will meet as needed and, in any case, at least quarterly.

The Council will preparc sumary notes for each meeting. These notes will-be reviewed and approved by both agencies prior to finali7ation. The notes will be made publicly available after they are finalized.
7.
The Council will keep the NRC Executive Director for Operations (ED0) and the EPA Deputy Administrator (DA) informed of interactions with the other agency, as appropriate. The ED0 and DA may call special meetings of the Council when necessary to facilitate timely resolution of interface issues.

Nothing in this agreement shall be construed as limiting f,rms of informal consultation and coordination not mentioned in this agreenent (e.g.,
telephone conversations, exchanges of reports, technical staff meetings).
