ORDER PROHIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES This is to inform the Commission that an Order Prohibiting involvement in NRC-Licensed Activities will be issued on or about September 18,1998, to David Milas. This action is based on an 01 investigation which concluded that Mr. Milas deliberately compromised the integrity of an NRC operator licensing examination by obtaining a photocopy of the NRC examination for his personal use prior to the date that the examination was to be administered. At the time Mr. Milas obtained a photocopy of the NRC examination, he was an applicant for an NRC operator's license and scheduled to take the examination he had obtained. Mr. Milas' actions were in violation of 10 CFR 50.5, " Deliberate Misconduct," and 10 CFR 55.49, " Integrity of Examinations and Tests." Mr. Milas was criminally prosecuted by the U.S. Attorney's office, Chicago, Illinois, and he pleaded guilty to compromising the integrity of the NRC examination. However, Mr. Milas' plea agreement only prohibited his involvement in NRC-licensed reactor activities. The Order prohibits Mr. Milas from engaging in NRC-licensed activities for a period of five years, and requires Mr. Milas to provide notice to the NRC each time for a period of five years following the prohibition that he engages in NRC-licensed activities.

It should be noted that the individual has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
