The Nuclear Regulatory Commission had published in the Federal Register, of April 28, 1988, notices that it received applications from All Chemical Isotope Enrichment, Inc. (AlChemIE) for (1) a construction permit and facility operating license to use centrifugal machines to enrich non-radioactive isotopes at the existing Centrifugal Plut Demonstration Facility located in Oak Ridge, Tennessee, and (2) (

construction permit for a facility to use centrifugal machines to enrich non-radioactive isotopes at AlchemIE Facility-2 at Oliver Spring, Tennessee. The notices directed that Applicant's answers, requests for hearings and petitions for leave to intervene be filed by May 31, 1988.

  • j On May 26, 1988, NRC Staff entered an appearance in the proceedings. Applicant filed an answer to the Federal Reaister notices on May 28, 1988. The State of Tennessee, on behalf of the Commissioner of the Tennessee Department of Health and Environment, filed a request to participate in the application proceedings as an interested state pursuant to 10 C.F.R. 5 2.715(c). NRC Staff in a response to the State of Tennessee, of June 7,1988, welcomed the State's participation in the mandatory pennit hearing phase of the proceedings.

It is appropriate to schedule a special prehearing conference, pursuant to 10 C.F.R. I 2.751(a) in these proceedings. The parties and the State of Tennessee, or their counsel, are directed to appear at the special prehearing conference. It will be held in the vicinity of the facilities on July 21, 1988, and, if necessary, on the day following.

The time and place will be by further notice.

Matters to be discussed are those enumerated in 10 C.F.R. 6 2.751(a) and 6 2.904. The holding of a prehearing conference regarding the application for a facility operating license, under Docket No.

50-603-OL, should not be construed as indicating a hearing will be held on that application.
