PERRY INSPECTION REPORT 50-440/98018(DRP) AND
Dear Mr. Myers:
- in October 20,1998, the NRC completed a routine safety inspection at your Perry Nuclear
!-
Power Plant. The enclosed report presents the results of that inspection.
During this 6-week inspection period, the conduct of activities at the Perry facility was
i
characterized by continued safe and conservative operation, with good coordination between
i
work groups. - We are concemed, however, about a violation of NRC requirements that was
identified. Specifically, plant personnel failed to follow applicable portions of the plant fire
protection program when staging materials for maintenance and when performing hot work.
We have recently identified other fire protection related violations stemming from different root
causes that are described in Inspection Reports 50-440/97021 and 50-440/98010.~ lt is our
understanding that a condition report has been generated to address the collective significance

. of the violations identified associated with the fire protection program.

The violation identified during this inspection is cited in the enclosed Notice of Violation

. (Notice), and the circumstances surrounding the violation are described in detail in the enclosed -

report. Please note that you are required to respond to this letter and should follow the
' instructions specified in the enclosed Notice when preparing your response, in your response

to this violation, please also describe the corrective actions planned to ensure your staff will
,
generate transient combustible material permits as required. The NRC will use your response,
in part, to determine whether further enforcement action is necessary to ensure compliance with
regulatory requirements.
