By EN 98-055, issued July 27, 1998, the staff notified the Commission of its intent to exercise enforcement discretion and issue a Notice of Violation at Severity Level III without a civil penalty to Envirocare of Utah, Inc., on or about August 3, 1998.
Subsequently, the associated SECY Paper, SECY-98-108, was converted to notation vote. Therefore, the issuance of this enforcement action has been placed on hold pending further instruction from the Commission.
The licensee has not been informed concerning the enforcement action.
