Authority in the State of New Mexico."

The Commission is being asked to reassert 17 certain regulatory authority in the state of New Mexico, 18 effective June 1, 1986, by terminating the appropriate 19 portion of the section 274 B agreement with New Mexico i

20 covering uraniun, thorium milling and mill tailings.

21 All of you have approved the order and the Federal H

22 Register notice in the paper, as modified by Commissioner 23 Zech.

This order transfers all New Mexico-issued licenses, i

24 license amendments, outstanding orders if any, or other 4

25 documents establishin, obligations for specific licensees to i

5 CHAIRMAN PALLADINO:

I'd like to ask the question of 6

General Counsel so that we have a record of information on 7

which we're going to base a decision, and call attention to 8

the fact that we have a letter dated May 15, 1986 from five t

9 members of the Legislative Radioactive and Hazardous Materials 10 Committee of New Mexico.

They express opposition to Governor 11 Anaya's decision to return the regulatory responsibility for 12 uranium mill tailings to the. federal government, and they 13 point to two memorials, and I'm not sure what a memorial is, 14 that was passed by -- one in the House and one in the Senate

]

15 of the State of New Mexico.

16 I'd like to know from General Counsel whether this i

17 impacts in any way on the decision we're about to make.

18 MR. MALSCH:

I think the question is no.

Under the 19 statute, the Governor signs agreements with the Commission, 20 and the Governor is the one who requests termination of 21 agreements.

So I think we can assume that the Governor speaks i

i 22 for the state.

23 I would note that as I read the letter you refer to, 24 while the legislature is expressing some disagreement with the 25 actions of the Governor, they don't seem to question that the

Governor had the authority to do what he did; namely, request 2

terminations.

So I think we can go forward.
