Dear Mr. Thorne:

We are forwarding a letter dated October 17, 1988 from Nissho-Iwai American Corporation with a request to change the end user for low-enriched uranium originally exported to Japan for use in the JRR-4 (XSNM01780) to the Japan Research Reactor No. 3.

This request is similar to previous requests, the most recent of which occurred in August,1988 (see letter dated 8/26/88 signed by Richard Stratford (XSNM01909)).

Before taking action on this equest we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the proposed new end use for the 31.884 kilograms of material in the JRR-3 facility meets the applicable criteria in the Atomic Energy Act of 1954, as amended by the Nuclear Nonproliferation Act of 1978.
