PROPOSEDIMPOSITIONOFCIVILPEN/LTY-$2,500 This is to inform the Connission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Two Thousand Five Hundred Dollars
($2,500) will be issued on or about October 28, 1988 to Shadyside Hospital.
The Consission approved issuance of this action on October 20, 1968. This action is based on a violation involving the failure to recover and return a nuclear paceraker to the manufacturer upon the death of an individual. As a result of the failure to recover and return the nuclear pacemaker to the manufacturer, the paceraker was dis posed of by the funeral home in the normal trash, a method of disposal not autiorized by the licensee or NRC regulations.
The escalation and mitigation factors in the Enforcement Policy were considered and no adjustments were deemed appropriate.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice October 28, 1988 Telephone Notification of Licensee October 28, 1988 The State of Pennsylvania will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or it' posed by Order.
