Docket No. 72-1051; NRC-2018-0052, Holtec International HI-STORE Consolidated Interim Storage Facility Project The NRC has been going through the licensing process for the subject project now for several years with extensive and voluminous input from those opposed to the project. Our question and comment are as follows:

Question: As it now stands the application violates the law (Nuclear Waste Policy Act, 1982) since the U. S.

Department of Energy (DOE) cannot take title for the spent fuel as there is no permanent repository open nor is one being developed anytime in the foreseeable future. Why is the NRC, a Federal Regulatory Agency, processing an application that violates the law? Why is a Federal Agency aiding someone whose intention is to break the law?

Comment: If it was learned that someone was planning a terrorist attack which is against the law then a Federal law enforcement agency would act to stop them. The draft EIS that is currently under review is only part of this illegal activity that should have been rejected at the outset because of existing Federal law. This is not a rhetorical question and not the first time this question has been raised. However, we have never seen an explanation as to why the NRC is allowing this illegal application to go forward. We would like an answer as to why a Federal agency supported by our tax dollars is pursuing this course.
