U.S. NUCLEAR REGULATORY COMMISSIONS SCHEDULE UPDATE FOR THE LICENSE RENEWAL REVIEW OF THE WESTINGHOUSE COLUMBIA FUEL FABRICATION FACILITY

Dear Ms. Pope:

I am writing to inform you of an update to the U.S. Nuclear Regulatory Commissions (NRC) schedule for review of the Westinghouse Electric Company, LLCs (Westinghouses) application to renew license SNM-1107. By letter dated, June 5, 2020 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML20150A289), we informed you that the NRC would be preparing an environmental impact statement (EIS) to document its environmental review of the renewal application. The NRC is committed to completing the EIS for the Westinghouse license renewal application in the most efficient and effective manner possible. To that end, the NRC staff has determined that the environmental review can be most efficiently completed by informing our schedule with the activities that Westinghouse plans as part of the Phase II Remedial Investigation Work Plan. Once the NRC receives the requested information, as discussed below, a reliable and efficient schedule for the entire EIS can be established.

The NRC staff will use the analysis conducted to date to the fullest extent possible to prepare the EIS. The NRC staff must comply with the requirements for completing an EIS, including scoping. The NRC staff will issue a Federal Register notice, anticipated to be published in July 2020, to announce its intent to prepare an EIS, and initiate the scoping process per Section 51.26 of Title 10 of the Code of Federal Regulations (10 CFR). The scoping process will include accepting written comments from the public and interested stakeholders on the scope of the EIS during a 30-day comment period. Once the draft EIS has been prepared, the NRC will publish it for public review and comment per 10 CFR 51.73.

As stated in our previous letter, it was the NRCs intention to issue a review schedule by the end of June 2020. However, before providing a schedule for the remainder of the environmental review, the NRC requests that Westinghouse provide dates for the Phase II Remedial Investigation Work Plan activities, under the Consent Agreement with the South Carolina Department of Health and Environmental Control (SCDHEC), including when the Plan will be submitted to SCDHEC and when the results will be available. The requested information should be provided to the NRC within 30 days from the date of this letter. Once the requested information is received on these foundational scheduling aspects, a schedule for the entire EIS process can be established.
