COMMONWEALTH OF MASSACHUSETTS NOTICE OF WITHDRAWAL OF ITS PETITION FOR LEAVE TO INTERVENE AND HEARING REQUEST Petitioner, the Commonwealth of Massachusetts (Commonwealth or Massachusetts),

hereby withdraws its Petition for Leave to Intervene and Hearing Request, which the Commonwealth filed on February 20, 2019 (ADAMS Accession No. ML19051A114) (Petition) in the above-captioned proceeding and remains pending before the Nuclear Regulatory Commission (Commission) as of this date. The basis for this Withdrawal Notice is as follows:

1. On November 16, 2018, Holtec International, Holtec Decommissioning International, LLC, Entergy Nuclear Generation Company (now known as Holtec Pilgrim, LLC) and Entergy Nuclear Operations, Inc. (Applicants) jointly submitted an application for, among other things, the direct and indirect transfer of licenses (ADAMS Accession No. ML18320A031)

(Application) associated with the Pilgrim Nuclear Power Station (Pilgrim). On February 20, 2019, the Commonwealth filed its Petition with respect to the Application. On June 4, 2020, the Commission issued an Order allowing the joint motion of the Applicants and the Commonwealth

for a stay of issuance of a decision in this proceeding. The Commonwealths Petition thus remains pending before the Commission.

2. On June 16, 2020, the Commonwealth and the Holtec Applicants executed a settlement agreement that resolves, among other things, issues related to the decommissioning of Pilgrim. As part of that settlement agreement, the Commonwealth agreed to withdraw its Petition within fourteen days of the date the Commonwealth and the Holtec Applicants executed the agreement. Consistent with the terms of that agreement, the Commonwealth hereby gives notice that it withdraws its Petition. For clarity, the Commonwealths withdrawal of its Petition, however, does not affect the other Petition to Intervene and Hearing Request, which was filed by Pilgrim Watch on February 20, 2019 (ADAMS Accession No. ML19051A019) and thus remains pending before the Commission. Pilgrim Watch is not a party to the settlement agreement between the Commonwealth and the Holtec Applicants.
