Matt, By letter dated June 17, 2020 (Agencywide Document Access and Management System (ADAMS) Accession No. ML20171A352) Westinghouse Electric Company submitted WCAP-16097 Revision 5, Safety System Platform Change Evaluation. Based on its review of the information submitted in WCAP-16097, Revision 5, the NRC staff finds the TR is acceptable for referencing subject to the limitations specified in the TR, and in the NRC safety evaluation (SE).

A copy of the draft safety evaluation (SE) for the WCAP-16097, Revision 5 has been placed in the box.com folder. You have been given access to the folder.

In addition, the NRC staff has revised the full SE to incorporate the changes. A cop of this draft SE has also been placed in the box.com folder.

Based on its review of the information submitted by Westinghouse Electric Company, the Nuclear Regulatory Commission (NRC) staff finds the topical report (TR) acceptable for referencing subject to the limitations specified in the TR and in the NRC staff SE. The draft SEs are being provided for an accuracy, clarity, and proprietary information review.

Pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR 2.390),

we have determined that the draft SEs may contain proprietary information. If you believe that any information in the draft SEs is proprietary, please identify such information line-by-line and define the basis pursuant to the criteria of 10 CFR 2.390. Use brackets and yellow highlight to identify any [proprietary information]. After 10 working days, the draft SEs will be made publicly available, if appropriate, and an additional 10 working days are provided for you to comment on any factual errors or clarity concerns contained in the draft SEs.

The final SEs will be issued after making any necessary changes. The NRC staff's disposition of your comments on the draft SEs will be discussed in the comment response table.

When you respond, it must be via a letter from an authorized individual. Also, please provide an electronic Word file redline/strikeout version of the SEs either via email or the box.com folder. Plus, provide in the formal transmittal and in a separate Word file, a table with the following columns; Comment No., Page and Line No., Comment type (clarity, accuracy, proprietary), Suggested Revision, and a blank column NRC Disposition.

Note that at this stage of the process the NRC staff has completed its review of the submitted information and will not entertain technical arguments. The staff conclusions and conditions will not change unless new information is provided that was not available during our review. If Westinghouse would like to discuss the draft SE in detail, we can do that in a noticed meeting that can be closed if proprietary information will be discussed.

Both this email and the draft SEs have been placed in ADAMS and made Official Agency

Records. The draft SEs are declared as nonpublic because they may contain proprietary information. This email is declared public.
