REQUEST FOR COMMENTS ON MANAGEMENT DIRECTIVE AND HANDBOOK 5.8, PROPOSED SECTION 274B.
AGREEMENTS WITH STATES Provided for your review and comment is revised Management Directive (MD) and Handbook 5.8, Proposed Section 274b. Agreements with States. We request that you provide comments on the substance of the MD only; editorial changes will be addressed in the course of the MD review, before publication. This revision reflects changes resulting from update of the language in the standard agreement made by the Commission during the Vermont Agreement application process. This revision also reflects the reorganization and subsequent changed responsibilities of the Office of Nuclear Material Safety and Safeguards (NMSS).
Please provide your electronic comments on MD 5.8 by August 15, 2020. In coordination with the Office of the Chief Human Capital Officer, we will determine whether this MD will be provided to the National Treasury Employees Union for input. The Office of the General Counsel should include in its comments a determination whether, in accordance with the Congressional Review Act, this MD is a rule and must be reviewed by the Office of Management and Budget.
MD 5.8 will also be enclosed in a State and Tribal Communication letter and provided to the Agreement States for their review and comment. After considering and incorporating comments, as appropriate, the Director of NMSS will approve issuance of the MD pursuant to delegated authority under MD 1.1,Section III.E.
