SUMMARY

OF THE MAY 21, 2020, CATEGORY 2 PUBLIC MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND REPRESENTATIVES OF THE NUCLEAR ENERGY INSTITUTE AND INDUSTRY TO DISCUSS EMERGENCY PREPAREDNESS FREQUENTLY ASKED QUESTIONS On May 21, 2020, representatives from the U.S. Nuclear Regulatory Commission (NRC) and representatives of the Nuclear Energy Institute (NEI), the Boiling Water Reactor Owners Group (BWROG), and nuclear power plant industry held a Category 2 public teleconference to discuss the following Emergency Preparedness Frequently Asked Questions (EPFAQs) currently being considered by NRC staff:

  • EPFAQ 2019-004, Clarification of Revision 4 to the boiling water reactor owners group emergency procedure guide/severe accident guide on various emergency action levels,
  • EPFAQ 2020-001, Clarification of the requirement to perform an annual evacuation time estimate (ETE) update when developing an ETE analysis based on decennial census data, and
  • EPFAQ 2020-002, Clarification of emergency preparedness communication equipment requirements relative to extended loss of all power communication equipment requirements.

The above EPFAQs and meeting agenda can be accessed via Agencywide Documents Access and Management System (ADAMS) Accession No. ML20120A552. Over 20 individuals participated in the meeting, including industry stakeholders. No members of the public identified themselves as being present on the call. A listing of meeting attendees is enclosed.

K. Brock 2 EPFAQ 2019-004 During the meeting, the NRC staff asked two clarifying questions regarding EPFAQ 2019-004.

The first question related to using Primary Containment Flooding as a threshold value. The NRC emphasized that there may be conditions where, in Revision 4 of the Emergency Procedure and Severe Accident Guidelines (EPG/SAG), Primary Containment Venting may be delayed or not directed. The BWROG representatives indicated they understood the NRC staff concern and will provide further clarification.

The second question related to wording that implied that a proposed threshold value may not be required. The BWROG provided clarification that wording indicated that the threshold value would be site-specific and may not apply to all boiling water reactor designs. NEI provided a supplement to EPFAQ 2019-004 on April 20, 2020, (ADAMS Accession No. ML20162A069).

The supplement stated that EPG/SAG, Revision 4, could direct intentional containment venting in either Emergency Procedures or Severe Accident Guidelines. The NRC staff found the supplement to be clearly written and accepted the revised version of EPFAQ 2019-004 for review.

EPFAQ 2020-001 The NRC staff provided that guidance referenced in EPFAQ 2020-001 was currently being revised and would address the requested clarification on the requirement to perform an annual ETE update in relation to decennial census data. An industry representative requested clarification as to how revising guidance would modify the ETE requirements in Appendix E to 10 CFR Part 50. The NRC staff provided that the EPFAQ process is limited to clarifying existing guidance and does not modify or revise existing regulations. The NRC staff further provided that the guidance provided in the proposed revision to NUREG/CR-7002, Criteria for Development of Evacuation Time Estimate Studies (ADAMS Accession No. ML12340A656), will be noticed for public comment in the near future.

EPFAQ 2020-02 An update was provided regarding the status of EPFAQ 2020-002. Clarification was provided that a licensees emergency plan only needs to address the requirements in 10 CFR 50.47(b) and Appendix E to 10 CFR Part 50. There were no clarifications or questions concerning EPFAQ 2020-002.

An opportunity was provided for members of the public to ask questions or provide comments.
