PROPOSED REVISIONS TO 10 CFR 170 AND 171 ON LICENSE AND ANNUAL FEES Gentlemen:
On June 27, 1988, the U.S. Nuclear Regulatory Coninission published in the Federal Register (53 FR 2407) for public coment the enclosed Notice of Proposed Rulemaking. This notice proposes revisions to the fee requirements of 10 CFR 170 ("Fees for Facilities and Materials Licenses and Other Regulatory Services...") and 171 ("Annual Fee for Power Reactor Operating Licenses"). These revisions are being made to update the current fees and to implement Section 5601 of the Omnibus Budget Reconciliation Act of 1987 (Public Law 100-203) enacted by the Cong ress. The fee legislation requires the Comission to collect under 10 CFR 170 and 171, as well as under other provisions of law, not less than 45 percent of its costs for each of fiscal years 1988 and 1989.
Coments should be submitted by July 27, 1988.
The NRC staff will hold a public meeting to discuss the proposed changes and to answer any questions on July 7, 1988, at 3:00 p.m. in Room 2F-17 at the NRC's White Flint North Building,11555 Rockville Pike, Rockville, Maryland.
The major changes proposed to Parts 170 and 171 would:

Remove the fee ceilings for reactor and major fuel cycle permits, licenses, amendnents and inspections.

Revise the hourly rate in 10 CFR 170.20 for NRC professional staff time spe-t providing various regulatory services cnd provide for an annual adjustnent, c.
Charge for all routine and non-routine inspections; the current maximum billing frequency is being eliminated, f $h h

Re:nove the application fee for reactor facility license amendments and other approvals, as well as for reactor related reports.

Remove the application fee for standardized design approvals and defer payment of costs for standardized reactor design reviews and certifications until the standardized design is referenced.

Part 171:
Revise upward the annual fee ceiling and change the method of allocating costs so that those licensees requiring the greatest expenditure of NRC resources would pay the most fees.
In addition to the above, the notice being published solicits your coments on a second option. Under this option, the Comission at this time would not adopt any changes to Part 170 or Part 171 other than to raise the annual fee so that the amount of fee collected by the Comission under 10 CFR 171.15, when added to fees that would be collected under 10 CFR 170 as currently codified, would approximate, but not be less than 45 percent of the NRC budget.

On June 27, 1988, the U.S. Nuclear Regulatory Commission published in

Notice of Proposed Rulemaking. This notice proposes revisions to the

fee requirements of 10 CFR 170 ("Fees for Facilities and Materials Licenses and Other Regulatory Services...") and 171 ("Annual Fee for Power Reactor Operating Licenses"). The's revisions are being made to update the current fees and to implement Section 6601 of the Omnibus Budget Reconciliation Act of 1987 (Public Law 100-203) enacted by the Congress. The fee legislation requires the Comission to collect under 10 CFR 170 and 171, as well as under other provisions of law, not less than 45 percent of its costs for each of fiscal years 1988 and 1989.
Coments should be submitted by July 27, 1988. The NRC staff will hold a public meeting to discuss the proposed changes and to answer any questions on July 7, 1988, at 3:00 p.m. in Room 2F-17 at the NRC's White Flint North Building,11555 Rockville Pike, Rockville, Maryland.
The major changes proposed to Parts 170 and 171 would:
1.
Part 170:
Remove the fee ceilings for reactor and major fuel cycle a.
permits, licenses, amendments and inspections.
b.
Revise the hourly rate in 10 CFR 170.20 for NRC nrofessional staff time spent providing various regulatory services and provide for an annual adjustment, c.
Charge for all routine and non-routine inspections; the current maximum billing frequency is being eliminated.

Remove the application fee for reactor facility license amendments and other approvals, as well as for reactor related reports.
e.
Remove the application fee for standardized design approvals and defer payment of costs for standardized reactor design reviews and certifications until the standardized design is referenced.

Part 171:
Revise upward the annual fee ceiling and change the method of allocating costs so that those licensees requiring the greatest expenditure of NRC resources would pay the most fees.
In addition to the above, the notice being published solicits your comments on a second option. Under this option, the Comission at this time would not adopt any changes to Part 170 or Part 171 other than to raise the annual fee so that the amount of fee collected by the Comission under 10 CFR 171.15, when added to fees that would be collected under 10 CFR 170 as currently codified, would approximate, but not be less than 45 percent of the NRC budget.

NRC Af4EtiDS REGULATI0fis Ott INTERIl4 BASIS, TO INCREASE AllNUAL CHARGES FOR LICENSED POWER REACTORS The fiuclear Regulatory Conmission is amending, on an interin basis, its regulations to increase by 12 percent the annual fees charged to utility owners of licensed power reactors for liRC-incurred generic regulatory costs applicable to all nuclear pcwer reactor licensees, but not dir ctly attributable to a specific licensee, such as research and rulemaking.
The action is being taken to permit the Comission to increase the total fees it collects to an amount that equals at least 45 percent of its fiscal year 1988 budget as required by the Omnibus Buoget Reconciliation Act of 1987.
l The agency proposed amendments to all of its fees schedules in late June ot' this year; however, the public comment p(.riod on this proposed rulemaking did not end until July 27 and it will not be possible for the Commission to publish a final rule by August 15--the date by which invoices must be issued to enable it to meet the statutory mandate that the total fees collected be not less than 45 percent of the fiscal year 1988 budget, as opposed to 33 percent of the fiscal year 1987 budget.
Since the proposed rulemaking asked for public comment en a second option similar to the interin amendments the Comission now is promulgating, it is being made effective as an interim rule.
In the meantime, the flRC will fully consider all of the comments en the proposed amendments to Parts 170 and 171 of i
the Commission't regulations and the Conmission plans to issue final l
amendments, similar to the ones proposed, later this year.
These amendments will apply initially to the fiscal year 1989 budget.
