Dear Ms. Walker and Mr. Condit:
I am in receipt of your letter dated October 9,1998, in which, as part of the informal discovery process in this proceeding, you request a broad range of information from the NRC Staff concerning the safety record and funding of commercial nuclear power reactors, other fuel storage proposals that may be pending before the Commission, and the spent fuel storage needs and capacity of commercial nuclear power reactors throughout the country.
While I am interested in cooperating with Ohngo Gaudadeh Devia's effort to obtain informal discovery, your request is overly broad; seeks information that is not relevant to any admitted contention, is not necessary to a proper decision in the proceeding, and/or is reasonably obtainable from other sources; and would improperly require the Staff to perform extensive searches of publicly available information, which OGD, itself, is able to perform.
Accordingly, much of your request is objectionable. See generally,10 C.F.R. Q 2.744.
In particular, Request Nos. (1), (2), and (3) seek information that is beyond the scope of any admitted contention in the proceeding, is not reasonably necessary for a decision herein, and/or is publicly available. Request Nos. (4), (5), and (6) seek information that is publicly available or available from other sources, including the Applicant in this proceeding. Request No. (7) seeks information that is beyond the scope of any admitted contention in this proceeding and/or is publicly available. Request No. 8 seeks information that is publicly available, including documents filed by the Applicant and Staffin the docket of this proceeding.
Notwithstanding these objections, I have ascertained, with respect to Request Nos. (5) and (6), that a compilation of spent fuel storage capacity and needs has been published by the U.S. Department of Energy (DOE), Office of Civilian Radioactive Waste Management, entitled 9811120027 981109 PDR ADOCK 07200022 C

" Spent Fuel Storage Requirements 1994-2042," DOE /RW-0431, Rey. I (June 1995). This document provides a detailed summary of the spent fuel storage capacity and needs for each j
commercial nuclear power reactor in the United States. A copy of the DOE report can be obtained by calling (800) 225-6972. In addition, with respect to Request No. (7), I am enclosing copies of two slides prepared by the NRC Staff, which identify operating and potential near term spent fuel storage sites within the United States, as of November 4,1998.
Finally, with respect to your request for a list of persons who have personal knowledge concerning the matters identified in your letter, the Staff will provide the names of persons who have knowledge of the matters contained in the contentions and who will appear as Staff witnesses when the Staff states its positions on contentions, in accordance with the schedule established by the Licensing Board.
