SUMMARY
- PORTSMOUTH AND PADUCAH GASEOUS DIFFUSION PLANT COMPLIANCE PLAN ISSUE COMPLETION Recent NRC inspections and self assessments performed by the U.S. Enrichment Corporation (USEC) have indicated that certain Compliance Plan (CP) Issues / Items for the Portsmouth Gaseous Diffusion Plant (PORTS) may not have been adequately completed or closed. On October 15,1998, NRC staff met with staff from USEC and the Department of Energy (DOE) to discuss the issue of USEC's inadequate completion of CP issues / Items. NRC staff indicated that NRC inspections would assess the adequacy of USEC's CP issue /ltem completions and that enforcement actions for inadequately completed CP lssues/ Items would be based on the safety significance, proposed corrective actions, self-or NRC identification or the existence of a programmatic breakdown.
NRC staff indicated that it expects USEC to:

Assess all PORTS CP issues / Items for adequate completions. Propose a schedule for the PORTS CP lssue/ Item completion assessment task to the NRC. The Paducah O
Gaseous Diffusion Plant (PGDP) would do a similar evaluation or propose criteria for determining which PGDP CP issue / Item completions need to be assessed.

Propose criteria to the NRC for (a) defining completion of CP lssues/ Items and (b) determining when a previously completed / closed CP lssuelltem needs to be reopened.
3.
Propose a Justification for Continued Operation (JCO) immediately after identifying an inadequately completed CP issuelltem.

By way of a Certificate amendment, immediately reopen CP issues / Items that have already been identified as being inadequately t ompleted/ closed and are likely to meet the criteria of 2(b) above. Continue to reopen CP issues / Items as the assessment identifies CP lssues/ Items which meet the criteria of 2(b) above.

DOE staff involved in developing the CP and closing issues whose completion dates occurred I
before March 3,1997, indicated that they independently confirmed the completion of the action items in a completed CP issue in a literal sense and that they did not determind the adequacy of the completed action items. For example, if a CP issue action item required USEC to develop a procedure with certain key elements, then DOE confirmed the existence of the procedure and the inclusion of the key elements in the procedure but not the adequacy of the key elements. DOE also indicated that it will be able to review in a timely manner, any changes to the CP proposed by USEC.
USEC committed to respond with appropriate criteria within two weeks of the meeting.
