Dear Dr. Grace:
Joseph H. Farley Nuclear Plant - Units 1 and 2 Notice of Violation and Proposed Imposition of Civil Penalty By letter dated August 15, 1988, the NRC transmitted a Notice of Violation and Proposed Imposition of Civil Penalty related to NRC Inspection Report Nos. 50-348, 364/87-25 and 50-348, 364/87-30. That letter required Alabama Power Company to respond to alleged violations by September 14, 1988. During a subsequent telephone conversation between Mr. J. D. Voodard (Alabama Pover Company) and Mr. D. M. Verrelli (NRC-Region II), Alabama Power Company requested a ninety day extension to the required response date. This requested extension was based on the following:
- 1) the issues raised are, by themselves, highly technical and complex and are additionally complicated by the recently issued Generic Letter 88-07 2) the lack of precedent for the Modified EQ Enforcement Policy, coupled with the individual extensive research requirements associated with each alleged violation, further impacts the time necessary to provide a complete and meaningful responses and 3)
Alabama Power Company is presently developing a response to Enforcement Action 88-113, due October 3, 1988, which requires a significant allocation of resources - many of which are common to the develooment of the response to Enforcement Action 88-40.
On September 13, 1988, NRC Region II verbally granted a thirty day extension (to October 14, 1988) to the required response date. While this extension is helpful, Alabama Power Company, for the reasons indicated above, maintains that the full ninety day extension is varranted, justified and necessary.
Accordingly, it is requested that an extension up to and including December 13, 1988 to respond to this Notice of Violation be granted.
