Edward A. Thcnas, Chief of MIH Division, FEMA Region I, hereby moves pursuant to 10 CFR S2.720(f) that the subpoena which demands him to appear on May 27,1988 at 9:00 o' clock to testify on behalf of the Intervenors, Massachusetts Attorney General, e_t,al. be modified as follows:

1.

The date for his appearance be changed to read that he appear "on a date to be determined by the NRC Attnic Safety and Licensing Board af ter telephonic conference with counsel for the witness, Edward A. Thcmas",

and 2.

'Ihe witness is to have leave to file further appropriate motions with respect to his proposed appearance prior to the date so determined by the NRC Atcnic Safety and Licensing Board.

_2-The grounds tor this Motion are:

A.

Since the time that the witness became aware that he would no longer be represented in his professional capacity by FENA counsel, he has diligently sought the services of qualified counsel. The witness has consulted with and intends to retain as counsel for him a member of the Bar of the Ccrmonwealth of Massachusetts, Edward J. Barshak, Esq.

B.

As result of preliminary conferences, Mr. Barshak has already determined and advised the witness that ccmnents already on the record make it of paramount importance that he have counsel and that counsel be thoroughly prepared by reviewing the extensive record and in other ways.

C.

hhile the witness was served with the subpoena on May 23, and was generally aware that his further testinony may be sought, he has been unable to conclude negotiations with FEMA concerning its financial ccanittment to enable him to procure counsel. The witness has been and is diligently purusing such negotiations with FEMA, with the cooperation of his counsel of choice.

D.

It is expected that such negotiations with FEMA will be success-fully concluded forthwith and that the designated counsel for the witness would be available to confer next week with the NRC Atcrnic Safety and Licensing Board concerning future action with respect to the issue of an appearance by the witness, f
