ACCEPTANCE OF GUNNISON, COLORADO,' VICINITY PROPERTY GU-029 COMPLETION REPORT
Dear Mr. Rael:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the Gunnison, Colorado, Vicinity Property Ccmpletion Report (CR) for property number
' GU-029 (a section of South 9th Street) submitted by U.S. Department of Energy (DOE) letter dated December 8,1997 ' The CR was revised by submittals dated July 22 and October 7, 1998. The DOE requested NRC concurrence on this CR because, during remedial action, approximately 340 cubic yards of tailings contaminated soils were left around sewer lines. The
' decision to not remove the residual radioactive material (RRM) soil was based on the DOE conclusion that, because of the difficulty of removing the soil, the cost of remediation is i
unreasonable high relative to the health benefits as allowed under supplemental standards criterion c of 40 CFR 192.21. As a result of this contamination, an application for supplemental
. standards is included in the CR.
- The NRC staff reviewed the CR supplemental standards application and provided comments which were addressed by DOE in a revised CR and subsequent page changes. The staff comments were adequately addressed except for the concern that the health risk assessment in the CR is inappropriate. Since the NRC staff determined that the DOE's conclusion that little or no health benefit would be derived from removing the RRM, the NRC staff chose not to pursue this issue.
. The NRC staff determined that application of supplemental standards for the RRM around the sewer lines of GU 029 meets the U.S. Environmental Protection Agency standards. Therefore, 3 the NRC Review Form for Supplemental Certification of Vicinity Properties, containing NRC 1
