Thank you for your letter of September 10,1998, in regard to the potential disposal of radioactive materials from the Metcoa site in Pennsylvania at a Waste Cor. trol Specialists (WCS) site in Texas. The potential disposal of this material raises several new site-specific j

and generic issues for the Commission. Although WCS has provided us, through Ps counsel, Its views on these regulatory issues, any regulatory action by the Commission in regard to these materials would focus on the parties responsible for the cleanup of the Metcoa site rather than WCS. In addition, the State of Texas, not the Commission, has the authority for the j

disposition of these materials at the WCS facilities in Texas. The Commission is reviewing its responsibilities in regard to these materials and should reach a decision soon. I will keep you informed of this matter and will send you an update once the Commission's rsview ha. been l
