APPLICANTS' ADVICE TO APPEAL BOARD Applicants enclose herewith a press release of one of the joint owners, Massachusetts Municipal Wholesale Electric Company ("MMWEC"), which owns 11.5934% of Seabrook Station.

At present we do not have information additional to that contained in the press release. We are advised by project management, however, that MMWEC's a*.inouncement will have no j immediate effect on meeting projected project requirements.

We will, of course, keep this Appeal Board advised as to future developments concerning this matter.

LUDLoV Directors of the Massachusetts Municipal Wholesale  :

Electric Co. (MMVEC) today adopted a plan of action that calls for f withdrawal from the Seabrook Station nuclear project and restructuring of the co::pany's seabrook debt to moderate rate icpacts.

Under the plan racer ended by Central Manager Cary L. Nunt,  !

MHVEC will seek an agree:ent with other project owners "to take l YSEC out of the project in a financially responsibis =anner."  ;

.MWEC, which ovnt an 11.59 percent share of Seabrook, also will seek state cooperation in restructurin5 its debt in order to moderate rates.

  • In addition, the plan leaves open the possibility of legal action by MMUEC to recover Its $875 million Seabrook investment.

As the first step toward withdrawal, MMWEC will not make a payment of approximately $2 million due to the project today, h co=pany has prepaid about three months worth of seabrook payments and will draw from those prepayments while it pursues negotiations l vich other project owners, Hunt said that details regarding HHWEC's withdrawal frem the project will be determined by the course of negotiations with other proj ect owners, ,

Leary stressed that MIC intends to repay the coney it has borrowed for seabrook.

"NEC bondholdars should take heate in today's action,' he said. ";t actually improves their security by reducing the uncertaintyandfinancialstressas30ClatedWithSeabrook.

An icportant factor in NEC's decision is the Jan, 28 bankruptcy filing by Public Service of New 'dupshira (PSRI),

Seabrook's principal owner. The bankruptcy jeopardites an a5reement betvsen M EC and P'sNH that adds nearly $200 million in value to the project for NEC.

In addition, slippage in the schedule for Seabrook's j operation caused by legal dalays in licensing the plant have cut deeply into the Value of Seabroek to N EC.

"The risks have just become too high to jutify continued invastaant in the project." I.tary said.

As part of its plan to modarate rate impacts, N EC will file a petition wLeh the state Department of Public Utilities requesting authority to refinance its high interts; and taxable l Seabrook debt. It also will seek approval from Cov. Michael S. ,

Hunt said today's dacision Vill enable FXwT.C to devote more time to finding solutions to the power supply problems facing its members,theStateandNewEngland.

"I'here is a lot of work to be done in the areas of power supply, conservation,datandmanagtmentand&Widerangeofother energy services and policios," he said.
