NRC STAFF'S FURTHER COMMENTS ON THE STATISTICAL INFERENCE MEMORANDUM I. INTRODUCTION On November 11, 1985, the Licensing Boards 1# issued their

" Memorandum (Statistical Inferences from CPRT Sampling)" (" Memo-rand um") . Therein , the Board expressed certain propositions and con-cerns about the statistical sampling process developed and being used by the CPRT. The Board acknowledged that the CPRT Program Plan and results are not yet in evidence, but raised its concerns now to avoid delay at a later state in this proceeding. Memorandum at 1. The Board invited the comments of the parties on the points made in the Memo-randum. Memorandum at 4-5.

The Staff submitted its comments on the Board's concern regarding the potential need for an exemption from Appendix B (see Memorandum at

4) on January 30, 1986. "NRC Staff Comments on Statistical Inference

Memorandum" (" Staff Comments"). The Staff there indicated that the Board chairman consented to the Staff's proposal that it be permitted to respond to the Board's technical questions on statistics in a Supplemental Safety Evaluation Report ("SSER") evaluating the CPRT Program Plan,

, then expected to be issued at the end of February 1986. The Staff also indicated that it was the Board chairman's desire that if the issuance of the SSER was delayed, the Staff would endeavor to address the matters raised in the Memorandum in a separate filing. Staff Comments, pp.2-3 and n.5.

By letter of February 28, 1986, the Staff informed the Board that issuance of the SSER would be delayed beyond the end of February, and that the Staff would respond to the Board's Memorandum in a separate filing to be submitted by March 14, 1986. Subsequently, the Staff informed the Board that this filing would be submitted by April 4,1986.
