Dear Mr. Murphy:
Pursuant to Subtitle E cf the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801, the U.S. Nuclear Regulatory Commission (NRC) is submitting a final amendment to the Commission's rules in 10 CFR Part 20. NRC is amending its regulations concerning low-level radioactive waste shipment manifest information. The currently effective codified regulations include a dualimplementation procedure that allows use of one of two manifesting procedures. The use of new manifesting requirements, (promulgated on March 27,1995),
became mandatory on March 1,1998. Therefore, this action is necessary to remove expired provisions from the regulations. An additional correction is being made to Part 20's scope section, to rectify an inadvertent change.
We have determined that this rule is not a " major rule," as defined in 5 U.S.C. 804(2). We ha - .
confirmed this determination with the Office of Management and Budget.
Enclosed is a copy of the final rule that is being transmitted to the Office of the Federal Register for publication. This final rule will become effective 60 days after publication in the EndeLid Reaister.
