Dear Mr. Davis:

This letter is in response to the inspection conducted by Messrs. T.J. Madeda and B. Drouin of Region III from June 6 through 21, 1988, of activities at Braidwood Station. Reference (a) requested that Commonwealth Ediscri review NRC concerns that address the issue of use of deadly force a3ainst an intruder armed with a bomb, and to provide a written response that explains Commonwealth Edison's position regarding this matt.sr. The Commonwealth Edison Company response to this request is provided in the enclosure. Per a telephone call with Mr. J. Creed on August 31, 1988, an extension until September 16, 1988 for submittal of this response was granted.

Commonwealth Edison's policy of deadly force, as currently stated in the security plan has been establish in accordance with 10 CFR 73.55(h)(5). Accordingly, the enclosed Commonwealth Edison opinion addresses the issue of use of deadly force against an armed intruder with a bomb. Essentially, if a guard has reason to believe that an intruder has a bomb in his possession and has reason to believe that the intruder poses an immediate threat of death or serious bodily injury, then the use of deadly force would be justified.

To implement t'ais position not only at Braidwood Station, but at all Commonwealth Edison nuclear stations, the information presented in the enclosure will be provided to the guard force vendors for review by their Legal Counsel to establish the proper means of implementation. Upon completion of that review, Commonwealth Edison will coordinate a training program with the guard force vendors as deemed appropriate for each case. This training program will begin during the first quarter of 1989 and will continue until all guard force members have received the appropriate instruction.
