Dear Mr. Robertson:

' We have reviewed the final Washington regulations WAC 246-249, Radioactive Waste - Use of the Commercial Disposa! Site, WAC 246-250, Radioactive Waste - Licensing Land Disposal, and WAC 246-252, Radiation Protection - Uranium and/or Thorium Milling, which became effective on September 7,1991, January 9,1994, and July 9,1994, respectively. These regulations were submitted to NRC for review with your letter dated September 1,1998. The regulations were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts

20. 40 and 61. We also discussed our review of the regulations with Mike Elsen on September 24,1998.

As a result of the NRC review, we have determined that the Washington regulations, as adopted, meet the compatibility and health and safety categories established in OSP Internal Procedure B.7.
