SUBJECT:

STAFF REQUIREMENTS - SECY-98-231 - AUTHORIZATION OF THE TROJAN REACTOR VESSEL PACKAGE FOR ONE-TIME SHIPMENT FOR DISPOSAL This is to advise you that the Commission has not objected to the staff's plan to grant two specific exemptions from the package test requirements specified in 10 CFR Part 71 for the Trojan Reactor Vessel Package (TRVP) and to authorize the TRVP for one-time transport for disposal. The staff should 1) submit the Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) to the Federal Reaister for publication, 2) issue the letter to Portland General Electric Company granting the two specific exemptions from Part 71 and authorizing the TRVP for shipment after publication of the EA and FONSI, and 3) Inform the NRC's Congressional oversight committees, the States of Oregon ana Washington Congressional delegations, the Governors of both States, and other interested elected officials of this action by letters signed by the Chairman. The Washington Department of Health-responsible for the waste classification of the TRVP-should also be notified of the NRC's final decision in this matter. The following editorial changes should be made:

The following sentence should be added to the end of the first paragraph of the letter to the Trojan Nuclear Plant: "The Commission has also determined that the TRVP shipment wi!I not significantly affect the public health and safety or adversely impact the environment."

The first sentence of the draft Congressionalletter should be modified to read as follows:

"This letter is to inform you of the U.S. Nuclear Regulatory Commission's (NRC) final decision on...."
