SUPPORTING STATEMENT FOR 10 CFR PART 71 PACKAGING AND TRANSPORTATION OF RADI0 ACTIVE MATERIAL Description of the Information Collection The proposed 10 CFR Part 71 revision would add 3 requirements to those already contained in the transportation regulations as follows:

1.

S71.13(a)(3) would require that a Type B package approved under NRC regulations be assigned a serial number which uniquely identifies each packaging which conforms to the approved design and which is legibly and durably marked on the outside of each packaging.

2.

S71.38(c) would require that an applicant, in applying for renewal of an existing Certificate of Compliance (package approval) or an existing Quality Assurance Program Approval, combine all previously submitted material which is still applicable in a consolidated application for renewal.

3.

671.91(a)(1) would require that a licensee who ships radioactive material in a package approved by NRC maintain a record of the identity of the package used by serial number in addition to the model number as presently required.

Justification Need for the Information Collection NRC regulations in 10 CFR Part 71 establish requirements for packaging, preparation for shipment, and transportation of licensed material, and prescribe procedures, standards, and requirements for approval by NRC of packaging and shipping procedures for fissile material and for quantities of licensed material in excess of Type A quantities.

Section 71.13 would require that a Type B package approved under NRC regulations be assigned a serial number.

For international shipments, Member States of the International Atomic Energy Agency have agreed to accept packages that no longer satisfy the current standards provided no further packages of the approved design are fabricated after a specified date and the package design is approved by the Member State.

The serial number requirement is necessary to control what packages have been fabricated before that date and thus to implement that agreement.

a Section 71.38 would require that an existing licensee who is applying for renewal of its package approval or quality assurance program approval certificates combine all previously submitted material which is still applicable in a consolidated application for renewal.

It is Agency practice for information submitted by an applicant in support of its application for approval, when that information constitutes a safety related commitment on the 1

part of the applicant, to reference that information in the approval certificate.

To reference a large number of documents for this purpose can be confusing and therefore detrimental to safety.

The purpose of the consolidation requirement is to minimize the number of documents referenced and thereby clarify the licensees obligations.

Section 71.91 would require a record of each individual package used by serial numbers. As the package standards change over the years, deadlines are established beyond which fabrication of further packages of certain designs is prohibited.

The requirement for identification by serial number is necessary to allow this continued use of existing hardware while prohibiting further fabrication of packages of certain designs.

The record must be retained for a period of three years af ter the last shipmei.t for which the package was used.

Agency Use of Information The serial number assigned and applied to Type B packages approved under NRC regulations will be used by NRC to maintain a knowledge of packages fabricated to the approved design before a specified date.

Section 71.13 does not allow use of certain packages fabricated af ter that date.

The NRC transportation licensing staff would review the information submitted with the consolidated application to determine whether an applicants package design, description, evaluation, quality assurance program, and other procedures and programs described in the consolidated application are adequate to meet current standards or the grandfather clause.

A consolidated application is more difficult for the applicant to prepare, easier for the NRC staff to review, and more clear and precise for all parties involved.

Identification of individual packages by serial number in the licensee's files allows NRC inspectors to identify an individual package and the date its fabrication was completed to determine if the package qualifies under a general license or grandfather clause.

Reduction of Burden Through Information Technoh There are no legal obstacles to reducing the burden associated with this information collection.

Applicants and licensees may use electronic information processing systems to prepare and submit required information, and may use electronic sendir.g and receiving devices to request and obtain approvals.

Effort to Identify Ouplication In the United States, only NRC, the U.S. Department of Transportation (00T) and the States impose requirements relative to radioactive material transportation.

A review of NRC requirements in 10 CFR 71, DOT requirements in 49 CFR 173, and State requirements in "Suggested State Regulations for Control of Radiation,"

prepared by NRC, the National Center for Devices and Radiological Health of the U.S. Department of Health and Human Services (HHS), and the U.S.

Environmental Protection Agency (EPA), reveals no duplication.

Neither a review of these documents nor interviews of pers>ns knowledgeable in the contents of these documents reveal any evidence of duplication.

E Effort to Use Similar Information A review of NRC requirements in 10 CFR Part 71, 00T requirements in 49 CFR Parts 173-178 and State requirements in "Suggested State Regulations for Control of Radiation," prepared by NRC, HHS and EPA reveals no similar information which could be used for these purposes.

Effort to Reduce Small Business burden Most businesses which transport Type B or Fissile packages or deliver them to a carrier for transport would not fall within the NRC definition of "small business."

The effort required to consolidate renewal applications is proportional to the size and extent of a licensee's program, making the required effort naturally less for a small business.

The requirement foc serial number records must be applicable to any licensee who uses a package under a grandfather clause and could not be reduced for a small business.

Consequences of Less Frequent Collections Frequency of collection is not an issue in the S?1.13 collection since the information is only collected one time.

Because a consolidated application is required only at renewal time, instead of, for example at every amendment of the approval certificate, it is applicable only every five years, already an infrequent occasion.

Recording shipment data to include package serial number is necessary for each shipment to provide for enfo, cement, so no less frequent collection is possible.

Circumstances Which Justify Variation From OMB Guidelines Not applicable.

Consultations Outside the NRC The consultant used who is expert in requirements of 00T regulations is Michael Wangler, Division of Hazardous Materials, U.S. Departinent of Transportation.

Washington, DC, 20950.

The Source of Burden and Cost Data is based on estimates from earlier informal consultations by NRC staff with a small number of typical licensees.

The total number of consultations did not exceed nine.

Estimated Annualized Cost to the Federal Government The Federal Government never actually receives the information requirea in S71.13, and so expends no review or processing costs.

NRC review of a consolidated application is more efficient and thus less costly than if the application were not consolidated.

NRC review of package serial number records is an insignificant addition to an NRC inspector's review of licensee's records.

a Reasons for Change in Burden The burden estimated here represents an increase of 2700 hours0.0313 days <br />0.75 hours <br />0.00446 weeks <br />0.00103 months <br /> and $162,000 over the annual industry burden estimated under the current clearance.

The increase results primarily from the additional requirement that applicants for renewal of package design certificates or quality assurance program approval certificates consolidate their applications for renewal.
