SUBJECT:

AUTHORIZATION OF THE TROJAN REACTOR VESSEL PACKAGE FOR ONE-TIME SHIPMENT FOR DISPOSAL' PURPOSE:

Request Commission approval, by negative consent, for the staff to grant two specific exemptions from package test requirements specified in 10 CFR Part 71 for the Trojan Reactor Vessel Package (TRVP), and to authorize the TRVP for one-time transport for disposal.

BACKGROUND:

Portland General Electric Company (PGE) has requested approval of the TRVP (including intemals) for transport to the disposal facility operated by US Ecology on the Hanford Nuclear Reservation near Richland, Washington. PGE has proposed transporting the TRVP from the Trojan Nuclear Plant near Rainier, Oregon, up the Columbia River by barge to Port of Benton, Washington, and from there to the Hanford site by overland heavy-haul transporter. PGE's schedule for shipment in late summer 1999, includes grouting the vessel in November -

December,1998. Failure to grout the vessel by December 1998, would delay shipment until.

l Commi==ioner McGaffiann's Comments on SECY-98-231:

I have no objection to the staff's plan to grant two specific exemptions from Part 71 l

transportation package test requirements for the Trojan Reactor Vessel Package (TRVP) and l

authorize the TRVP for one-time shipment to the disposal facility operated by U.S. Ecology on the Hanford Nuclear Reservation near Richland, Washington. I also suggest the following edits.

The following sentence should be added to the end of the first paragraph of the letter to the Trojan Nuclear Plant: "The Commission has also determined that the TRVP shipment l

will not significantly affect the public health and safety or adversely impact the environment."

The first sentence of the draft Congres'sional letter should be modified to read as follows:

"This letter is to inform you of the U.S. Nuclear Regulatory Commission's (NRC) final decision on...."

The Washington Department of Health-responsible for the waste classification of the

- TRVP-should also be notified of the NRC's final decision in this matter.

-The Oregon, as well as Washington, Congressional Delegations and the. Governors of both States should be notified of NRC's final decision in the matter by a letter signed by the Chairman.
